Summary of Pending Case: Swick, et al. v. Fidelity National Title Insurance Company, et al. (D.N.J.); Dolan, et al. v. Fidelity National Title Insurance Company, et al. (E.D.N.Y.); Holt v. Fidelity National Title Insurance Company, et al. (E.D. Pa.). The firm represents plaintiff classes of direct purchasers in a multidistrict class action alleging that the major providers of title insurance illegally conspired and agreed to fix and artificially inflate the price of title insurance in New Jersey, New York and Pennsylvania, respectively. In the New Jersey case, defendants’ motions to dismiss are fully briefed and awaiting decision. In New York, the Court recently granted defendants’ motions to dismiss and plaintiffs have appealed that ruling. In Pennsylvania, the Court granted in part and denied in part defendants’ motions to dismiss, and upheld plaintiffs’ federal antitrust claims for injunctive relief.
